Electronic signatures

Nowadays, more or less everything can be done online…

However, one uncertainty remained: are emails or even text messages sufficient evidence to prove that a contract has been concluded? Conflicting rulings have been issued on the matter, creating further uncertainty around this question.

To clarify the situation, a new law on concluding contracts electronically came into force on 20 October 2018.

Goodbye uncertainty: the law has been relaxed, encouraging transactions to be digitalised.

Since 20 October, you can therefore conclude a sale agreement by email. As soon as there is an agreement on the property and the price, even electronically, the sale is concluded!  However, the authentic deed must still be executed before a notary!
