When you buy a new-build property, you are protected by the Breyne Law. This law was passed to protect buyers of properties purchased off-plan or while under construction, intended for residential use (as a main residence, second home or rental property) and located in Belgium.

For the past four years, there has been talk of “Passive 2015”. New buildings are required to meet certain standards in terms of building energy performance. This involves choosing the right materials and taking environmental considerations into account. Thanks to this new requirement, energy consumption is much lower, delivering significant financial and environmental benefits.
The possibility of taking action against someone
In the event of a problem, the buyer is covered against hidden defects for one year. They will therefore be able to lodge a complaint against the responsible party if, for example, their window frames do not stay in place. In addition, the Breyne Law provides for a ten-year guarantee, meaning that if there is a problem relating to the building’s stability or watertightness, the developer, builder and architect must take action.
