
What happens to discriminatory landlords? In 2016 and 2017, the Brussels authorities conducted a survey into the selection of prospective tenants. In short, it clearly revealed cases of discrimination in the choice of tenant. This was mainly based on the source of income, gender and ethnic origin.
The Brussels-Capital Region has decided to tackle this inequality.
What is the fine?
At the beginning of September, an ordinance strengthening the fight against discrimination came into force.
Indeed, where differential treatment is established, it provides for a fine of between 125 and 6.200 euros. “However, the statutory surcharges are applied to these amounts, which must therefore be multiplied by 8″, according to Legal World. This means a fine of between 1.000 and 49.600 euros. “If the offence is repeated within 5 years, the fine may also be doubled, although it may not exceed the maximum of 99.200 euros (6.200 euros x 8 x 2).”
Of course, those concerned will have the right to present their case before being subject to such an administrative fine. The accused may defend themselves at a hearing, which will determine whether the difference in treatment between two prospective tenants can be reasonably justified.
Anti-discrimination measures
Lastly, to detect possible discrimination by estate agents or landlords, two types of test are planned: a situation test (comparing two similar profiles, with the difference being a potentially discriminatory criterion) and a mystery shopper test (checking that an estate agent does not agree to a discriminatory request from a (fictitious) client).
