Building work: how can you ensure compliance?

Are you planning to carry out work or renovation work? Before you begin, you should be aware that there are several regulations you must comply with; we discuss them in this article.

Obtaining planning permission

A planning permission, formerly known as a building permit, authorises you to carry out construction work. Planning permission is mandatory for certain types of work; please note that you must submit your application to your local authority.

Planning permission is required for any installation, demolition, reconstruction or alteration of a permanent structure on a plot of land, such as a house or garage. It is important to note that working with an architect is mandatory for a new build or major alteration(s); the architect will then be responsible for preparing the planning permission application and submitting it to the relevant authorities.

For certain small-scale works, you may submit the application yourself. However, some minor works do not necessarily require planning permission.

Lastly, remember to display the planning permission issued to you before work begins and throughout the entire duration of the works, otherwise you may be committing a planning offence.

Regulations vary from region to region

Legislation relating to spatial planning and development changes regularly. In addition, each region has its own codes and regulations. It is therefore important to consult your own region directly. If you need information, you can contact your local authority’s spatial planning department.

Carrying out work in a co-owned property

As an owner, you may carry out any work you wish in your apartment. You do not need any special permission unless this is specified in the co-ownership rules. However, you may not alter the common areas: all work must be decided upon at general meetings. Taking action on your own initiative is therefore not permitted.

For the work to be carried out, three quarters of the votes at a general meeting are generally required. However, if this majority is not reached, it is possible to bring proceedings before the Justice of the Peace.

If you believe that work needs to be carried out, you can submit a written request to the property manager, who will then raise the matter at the next general meeting.
