Your tenant does not want to leave? You have given your tenant notice, but they would like to extend their notice period. Are they entitled to do so?
Under what conditions?
In certain exceptional circumstances, the tenant may request an extension of the notice period. For example, in the event of pregnancy, sudden unemployment or illness.
They must submit their request by registered letter at least one month before the lease expiry date.
If the tenant does not want to leave, they may request that the extension be renewed once.
Do you disagree?
As the landlord, you are under no obligation to accept this request. However, be aware that the tenant may take the matter before the justice of the peace. You are likewise entitled to do so if they do not leave at the end of the lease. According to a recent ruling, even if they subsequently appeal the decision, this will not prevent you from having them evicted.
